"Bitaxe Baller," "we," "us," and "our" refer to the Bitaxe Baller software (desktop app, mobile apps, and marketing site), built and operated by Nathan Baldwin / 465 Media, a sole proprietorship based in New Hampshire, USA. "You" means anyone who downloads, installs, or uses the software, or visits the marketing site.
Bitaxe Baller is provided AS IS without warranty of any kind, express or implied. We make no guarantees about merchantability, fitness for a particular purpose, or non-infringement. The software is open source under the MIT license; the same disclaimer applies.
Mining Bitcoin (or any cryptocurrency) and overclocking ASIC hardware involves real risk of equipment damage. The recommendation engine, auto-tune sweeps, and tuning presets in this app exist to help you make informed choices — they are not professional advice and they will not always be right. You are solely responsible for the settings you apply to your hardware and the outcomes of those settings. If you damage your Bitaxe by pushing it too hard, that's on you. The README has the same warning in bigger letters.
The free tier of Bitaxe Baller is free for life. The Pro tier is a paid annual subscription, currently $29/year, that unlocks bulk tuning, auto-tune sweeps, 90 days of local SQLite history, Discord alerts, in-place auto-updates, remote access via relay.bitaxeballer.com, and the iOS + Android mobile apps. One Pro license activates on up to 5 desktop installs (Mac, Windows, or Umbrel); each install can monitor an unlimited number of Bitaxe miners on its LAN. You can deactivate any install yourself at bitaxeballer.com/account.
Pro is billed annually on a recurring basis through Stripe. You can cancel at any time from the Stripe customer portal linked in your purchase confirmation email or by emailing support. Cancellation takes effect at the end of your current billing period; you keep Pro features until then.
If you're not satisfied within the first 14 days of your initial Pro purchase, email support and we'll refund you, no questions asked. After 14 days, refunds are at our discretion (we'll usually still help if you have a legitimate problem — for example, the activation failed and we couldn't fix it). Subsequent renewals are non-refundable, but you can cancel at any time to prevent the next charge.
Your Pro license key is a personal credential — treat it like a password. Sharing it with someone outside your household to circumvent the 5-install limit is a violation of these terms. (The 5 is the number of desktop installs the license activates on — you're not limited on the number of Bitaxe miners any one install monitors.) We may revoke a license that's actively being shared (e.g. activations across more than a handful of distinct IP regions in a short window). We will email you before doing this except in cases of obvious abuse.

The MIT license on the source code lets you fork, modify, and use it however you want, including commercially. The terms above apply to the hosted services and our license-key system, not to your own forks.
The app and site integrate with: Stripe (payments), Cloudflare (CDN + DNS in front of the marketing site and relay), GitHub (release downloads + auto-update appcast), Apple (notarization, App Store, Push Notification Service if you use the iOS app), Google (Play Store, Android), Acumbamail (email), and Azure Trusted Signing (Windows code-signing certificate authority). Each has its own terms and privacy policies; we have no control over them. See our privacy policy for what data flows where.
We host the license server, the marketing site, and the remote-access relay on a single VPS. We aim for high uptime but don't promise it — we're a one-person operation. If the license server is down, your Pro features will continue to work (the desktop app caches license validation for 24 hours and degrades gracefully when offline). If the relay is down, your local LAN dashboard still works fine; only the remote dashboard at relay.bitaxeballer.com is affected. Outage updates go on GitHub Issues.
To the maximum extent permitted by law, our total liability to you for any claim relating to Bitaxe Baller is limited to the amount you have paid us in the 12 months preceding the claim. For free-tier users, that amount is zero. We are not liable for indirect, incidental, consequential, special, or punitive damages, including (but not limited to) hardware damage, lost mining revenue, lost shares, lost time, or data loss.
We may update these terms when we need to (new feature, new payment processor, legal change). Material changes get an in-app notification and an email to active Pro subscribers. Continued use of the app after a material change counts as acceptance; if you don't accept, cancel Pro and uninstall.
These terms are governed by the laws of the State of New Hampshire, USA, without regard to its conflict-of-law principles. Any dispute will be resolved in the state or federal courts located in New Hampshire.
